New Delhi [India], November 13 (ANI): The Delhi High Court on Wednesday issued a fresh notice to Bharatiya Janata Party (BJP) leader Harish Khurana to appear in the appeal moved by Sunita Kejriwal, wife of former Delhi Chief Minister Arvind Kejriwal, challenging a summoning order against her.
Sunita Kejriwal was summoned in the complaint moved by Harish Khurana. This matter is related to her being listed in the electoral rolls of two different constituencies.
Justice Chandra Dhari Singh issued the notice to Harish Khurana, instructing him to appear by December 10.
“It is made clear that if he does not appear on the next date, the court will proceed without his presence,” Justice Singh said.
The bench was informed that the respondent has not appeared on several occasions
Senior advocate Rebecca John along with Karan Sharma and Mohd. Irshad Khan represented Sunita Kejriwal.
Sunita Kejriwal senior counsel argued that she made a declaration regarding the shifting of the residence. Thereafter, it was the electoral officer’s responsibility to update the voter list.
“Where is the fault of the person, the declaration has been given, interstate communication is also there, despite the name is still there,” Justice Chandra Dhari Singh.
The bench noted that as per the office report respondent Harish Khurana is duly served. He has not appeared on four occasions.
The Delhi High Court had previously granted an interim stay on the summoning order on November 6, 2023, after Sunita Kejriwal approached the court.
The Tis Hazari court originally issued the summons on August 28, 2023, based on Khurana’s complaint. (ANI)
